Supplementary documentation required when placing personnel with companies
Validity and priority of your agreement
The following documentation requirements apply to business clients only if this addendum has been effectively incorporated into the respective brokerage agreement. Publication on this website alone does not modify any existing contract. Individually agreed-upon terms take precedence. The commission rate, basis of calculation, term, and deadlines are governed by the relevant agreement; a one-time fixed fee will not be converted into a recurring fee.
Start, ongoing billing and changes
The client shall notify the employee of the actual start date of work, any failure to appear, and the end date of employment within the agreed timeframe. For agreed-upon recurring payments, the client shall provide all necessary, accurate information for invoicing, clearly assigned to the respective employee and billing month. For hourly rates, this refers to the agreed-upon relevant hours; for percentage-based rates, it refers to the agreed-upon gross wage base. For fixed-rate payments, additional wage amounts will only be requested if they are specifically required in the case at hand.
A standard document is an extract from the payslip, confirmed by the employer or their payroll department, limited to the necessary information. An equivalent confirmation or suitable timesheet is acceptable. Unnecessary information, in particular tax and social security numbers, bank details, religious affiliation, and health information, must be removed or redacted. Confirmation may be provided in written form by an authorized person; official certification is not required.
Proof of termination
Termination of employment can be confirmed by a data-minimizing redacted extract from the social security deregistration certificate, once available, or by equivalent suitable proof, such as confirmation from the employer or payroll department stating the actual end date. Any outstanding documentation must be submitted promptly. Its absence alone does not imply continued employment or a fictitious further commission. Statutory and individually agreed entitlements remain unaffected.
Employee data and other placement partners
The employer and Pawelkorb independently assess the necessity and legal basis for each transfer and processing of personal data. This agreement does not replace a valid legal basis for the processing of personal data. Any employee consent obtained must be separate, voluntary, explicit, and revocable at any time for the future. Refusal or revocation must not result in any disadvantages for the employee regarding hiring, continuation, or other terms of employment, salary, or placement fees. Transfer to another placement partner requires a specifically named recipient, a specific necessary purpose, and a sound legal basis.
Documents are processed only for the validly agreed remuneration period and the required final invoice. Any further retention requires a continuing legitimate purpose or a legal obligation. Unnecessary components will not be retained.
